New EU Crypto Rules May Target DeFi, But It Won't Be Easy

Europe is exploring if its new crypto law, MiCA, should cover decentralized finance (DeFi) lending. Regulating these DeFi lending platforms, often called vaults, is proving tricky to figure out exactly who is responsible and how best to apply new rules.

The European Union is looking into whether crypto lending activities should be included under its new law, the Markets in Crypto-Assets Regulation (MiCA). This regulation aims to create a clear legal framework for digital assets across Europe. However, lawmakers face a challenge when it comes to decentralized finance (DeFi) lending vaults. These are platforms where users can lend and borrow crypto without traditional banks. It is hard to identify specific parties to regulate because DeFi operates with smart contracts and often without a central company or person in charge. This makes applying traditional rules difficult.
